Building a House in Poland Step by Step: Notification, E-Construction Journal, Acceptance, and Formalities (2026)

From plot to moving in 10 steps: project and notification instead of a permit, electronic construction journal, site manager and construction stages, notification of completion with a complete set of documents, and construction managed from abroad. Legal status: July 2026, verified against legislative texts after the amendment of the Construction Law in December 2025.

Building your own house is a project that takes 1.5 to 3 years, involves several official steps, and dozens of contractors – but it can be navigated without chaos if you know the order and deadlines. The good news: formalities are now simpler than ever – you can build a single-family house by notification (without a permit), applications are submitted online through the e-Budownictwo portal, and the construction journal is maintained on your phone. This guide takes you from the plot to moving in: project, notification, construction manager, construction stages, acceptance, and final formalities – with traps, deadlines, and tips also for those building "remotely" from abroad.

Step by Step: From Plot to Moving In

  1. Check what you can build (MPZP or WZ)

    The local plan specifies, among other things, the maximum height, roof angle, and building area; without a plan, you need a decision on building conditions.   2. Map for design purposes and soil testing

    A surveyor prepares a map for design purposes (takes a few weeks). Consider geotechnical testing – water levels and soil load-bearing capacity determine the foundations; this is the cheapest time to gain this knowledge.

  3. Project: ready with adaptation or individual

    A ready (catalog) project requires adaptation by a qualified designer to your plot and MPZP/WZ. The construction project consists of three parts: land development project, architectural-construction project, and technical project – the first two go to the office, the technical one is handed over to the construction manager before work begins.

  4. Conditions for utility connections

    Electricity: the operator issues conditions in 21–30 days, valid for 2 years; water/sewage: 21 days for houses, also 2 years. Submit applications in parallel with the design.

  5. Construction notification (or permit) – preferably online

    Through e-Budownictwo, you submit a notification with the project: the starost has 21 days to object – silence means consent. If your case requires a building permit, the authority issues a decision – and after exceeding 65 days, a penalty of 500 PLN for each day of delay is incurred (art. 35 sec. 6). If the land is agricultural – before starting work, you also need a decision to exclude it from agricultural production.

  6. Construction manager and construction journal

    You hire a construction manager (mandatory outside the 70 m² procedure) and set up an Electronic Construction Journal in the GUNB system – you can view entries from your phone, which is invaluable for remote construction. The surveyor marks the building on site. Also consider an investor supervision inspector – this is your person watching the contractors closely.

  7. Construction: zero state → raw → developer

    Typical stages: foundations, walls and ceilings, roof (open raw state), windows and doors (closed), installations, plastering and flooring, facade and finishing. Along the way: written contracts with contractors, stage protocols, photos, invoices (useful for sales and complaints).

  8. Acceptance of installations and inventory

    Gather test protocols: chimney, electrical, gas tightness, water-sewage – for your safety and for utility providers (the statutory attachment to the notification is only the gas installation tightness protocol). The surveyor conducts a post-execution inventory. You order a certificate of energy performance from a person from the central register (CHEB register).

  9. Notification of completion of construction

    You submit it to the county building supervision (can be done via e-Budownictwo). For a single-family house, you attach: the technical project with noted changes, statement from the construction manager about compliance with the project (with information about area measurements), geodetic documentation with inventory, certificate of energy performance, and – for gas – the tightness protocol (art. 57 with exemptions from sec. 1b for houses). After 14 days without objection, you can legally reside; the office may also issue a certificate of no grounds for objection earlier – then you can move in immediately.

  10. After acceptance: address, tax, utilities

    Application for address number to the municipality, information IN-1 (property tax is paid from January 1 of the following year after the completion of construction), final contracts with utility providers, home insurance, possibly registration.

Validity periods: you must start construction within 3 years (from the finality of the permit or the date indicated in the notification); a break longer than 3 years = necessity for new formalities.

People on the Construction Site: Who is Who

  • Designer – author/adaptor of the project; exercises author supervision.
  • Construction Manager – acts formally "for the construction law": keeps the journal, is responsible for compliance with the project and health and safety, signs the final statement. Choose your own, not "from the contractor".
  • Investor Supervision Inspector – optional (sometimes imposed in the permit), ensures quality on your behalf; when building from abroad – practically essential.
  • Surveyor – map, marking, post-execution inventory.
  • Contractors – "turnkey" team or in stages; always a written contract with scope, deadlines, and penalties.

Construction Journal on Your Phone and Online Applications

  • e-Budownictwo (e-budownictwo.gunb.gov.pl) – the official GUNB portal for submitting online applications, including construction notifications, permit applications, and notifications of completion.
  • Electronic Construction Journal (EDB system, app and browser) has been operational since January 27, 2023: you set up the journal online, grant access to the manager, and see all entries in real-time – from anywhere in the world.
  • Digitalization calendar: paper construction journals will be issued until December 31, 2031; from 2032 only EDB (art. 47v of the Construction Law after the amendment from December 2025 – the earlier date of "2030" is no longer valid).
  • You can check the qualifications of the designer and manager in the public register e-CRUB.

Technical Conditions and Energy Standard

  • The regulation on technical conditions from 2002 is in force (t.j. Dz.U. 2022 poz. 1225 with amendments – including "patodevelopment" from August 1, 2024).
  • The energy standard "WT2021" is still valid: for a single-family house, the primary energy demand indicator for heating and hot water EP ≤ 70 kWh/(m²·year) – in practice means good insulation, mechanical ventilation with recovery, or a very efficient heat source (heat pumps dominate in new projects).
  • A change is coming: the project of new technical conditions (implementing the EU building directive with energy classes) is planned to be applied from September 20, 2026 – for now, it is still a project, not law. If you submit documents in 2026, ask the designer which regulations will apply to your application.

Building Without a Permit – What are the Risks and How to Legalize

  • Building without notification/permit = suspension of work and legalization proceedings. The legalization fee for a single-family house is 50,000 PLN (rate of 500 PLN × 50 × category I coefficients – art. 49d and 59f of the Construction Law). Alternative: demolition order.
  • Simplified legalization: if at least 20 years have passed since the completion of construction, a simplified procedure applies – without a legalization fee (statement of the right to dispose, geodetic inventory, and technical expertise – art. 49f–49i). Note: you cannot use this if the 20 years passed after an earlier suspension of construction by supervision.
  • Illegal use (moving in without notification of completion) incurs separate penalties from building supervision – it is not worth it.

Building a House from Abroad – It’s Possible

  • Proxy for formalities (notification, notifications, offices) – a regular administrative power of attorney with a tax fee is sufficient; for notarial actions (purchase of the plot) – a notarial one.
  • EDB works from anywhere in the world – you see the manager's entries in real-time; also ask for weekly photo reports.
  • Supervision inspector is your eyes – invaluable in the absence of the investor.
  • Payments in stages after protocols, never "in advance"; plan transfers from abroad with time to spare (AML).

Common Mistakes

  • Project purchased before checking MPZP – the plan can exclude your dream roof or height.
  • Starting work before 21 days from notification or without excluding the land from agricultural production.
  • Construction manager "from the contractor" – a conflict of interest in the package.
  • Lack of contracts and stage protocols – disputes with the team without evidence.
  • Changes during construction without a designer – significant deviations from the project require formalities; unauthorized actions are costly.
  • Moving in without notification of completion – illegal use = penalties from building supervision.
  • Lost invoices and journal – documentation is your insurance for sales, complaints, and taxes.
  • Budget without reserve – realistically count +10–20% for surprises.

Frequently Asked Questions

Do I need a building permit for a single-family house?

Usually not – you build a free-standing house, whose area of impact is on the plot, by notification with a project (with a construction manager). A permit remains for twin/row housing and cases impacting neighbors.

How long do the formalities take before construction?

Realistically 3–6 months: map (2–6 weeks), project with adaptation (1–3 months), connection conditions (up to 30 days), notification (21 days of silence). Without a local plan, add time for WZ.

Can I build a house up to 70 m² completely alone, without a manager?

You can – but this is not "building without rules". With notification, you sign under penalty of criminal liability statements (building for your own needs, complete documentation) and take responsibility for the construction manager; an information board and geodesy are required, and upon completion, you submit a notification with a statement about area measurements (14 days for the office to object). The only real relief at the end: you do not need to attach an energy certificate. For most investors, a manager is still worth their price.

When can I legally move in?

After notifying the building supervision of the completion of construction and 14 days without objection (you attach a complete set of documents to the notification – including the manager's statement, geodetic inventory, and energy certificate, and for gas, the tightness protocol). The office may also issue a certificate of no grounds for objection earlier.

Will I get a VAT refund for building materials?

No – in 2026, there is no program for VAT refunds for building materials. The old VAT refund system was phased out years ago, and the mechanism for young people from the MdM act only covered invoices issued until September 30, 2018. If someone promises you "VAT refund from construction" – that information is outdated.

I'm building from the USA. How can I control it?

A proxy for offices, your own manager + supervision inspector, online EDB monitoring, payments after stage protocols, and 2–3 trips for key moments (zero state, raw state, acceptance) – this is a proven model. The purchase of the plot and notarial formalities will be handled by the proxy.

When can I sell the house without tax?
